《南京市国有土地上房屋征收与补偿办法》日前出台,今年6月1日起施行

  南京市政府日前发布《南京市国有土地上房屋征收与补偿办法》,就城市拆迁中一系列敏感问题作出了明文规定,要求拆迁评估和补偿过程全程公开,强调尊重拆迁户意愿。
  自国务院去年出台了《国有土地上房屋征收与补偿条例》,我省随后出台了实施意见。南京市依据这两个文件并结合本市实际,制定这一拆迁新规。
  规定进一步明确了:冻结户口最长不得超1年 ,补偿方案须公示30天 ,评估机构由拆迁户“挑选”,条件谈不拢,拆迁户可以选择三种途径救济, 安置房最长3年内拿到手,房屋征收部门不履行约定的,从逾期之月起,支付双倍的临时安置补助费等问题。


Measures on the Expropriation of Buildings on State-owned Land and Compensation in Nanjing Implemented on June 1, 2012

Recently Nanjing People’s Government has released Measures on the Expropriation of Building on Stateowned Land and Compensation in Nanjing in which a series of sensitive issues encountered in the process of expropriation are set forth expressly. These Measures set forth that the process of demolition evaluation and compensation process shall be disclosed and stress respecting the willing of the house owner.

Since the Regulations on the Expropriation of Buildings on Stateowned Land and Compensation released by the State Council, Jiangsu province also released implementation opinions. Nanjing thus formulated these new Measures based on these two files and in consideration of the localities of Nanjing.

Measures further clarify that to freeze the household registration shall not be more than one year; the compensation scheme shall be announced for 30 days; the evaluation agency shall be chosen by the houseowner; if two parties can not reach an agreement, the house owner has three ways to resort to; the relocated house shall be delivered to the house owner who has the house demolished within three years; if the house expropriation department fails to perform agreement, it shall pay double temporary relocation aids since the month overdue.
